Once Again, Clever Consult Successfully Represented Athlete. This Time at CAS

We previously succeeded in defending an athlete at RUSADA DAC. The elite athlete in question was charged with violation of article 4.4 of the Russian Anti-Doping Rules (Whereabouts Failures by an Athlete). The maximum sanction for the said ADRV is 2 years of the period of ineligibility.

With the charges being dropped, we are unable to disclose the athlete’s personal details, including their gender and the specific sport they participate in.

We are excited to announce that once again we have ensured the protection of the athlete's rights, this time within the proceedings held at the Court of Arbitration for Sport (the “CAS”) in Lausanne, Switzerland.  

RUSADA appealed the earlier decision of the Disciplinary Anti-Doping Committee, but ultimately did not prevail. Clever Consult legal team presented a compelling argument to the CAS, illustrating that RUSADA's determination to categorize the athlete as an international-level competitor was incorrect. Therefore, based on the provisions of the Russian Anti-Doping Rules, the CAS lacks the jurisdiction to hear such a case. 

With a carefully crafted and persuasive case, we succeeded in persuading the sole arbitrator to make a ruling in favor of the athlete. Thus, the RUSADA’s appeal has been dismissed, resulting in the closure of the case, and a substantial sum of legal costs has been claimed from RUSADA for the benefit of the athlete.
